2. About EVvoltarc

EVvoltarc is an EV charging platform intended to connect EV customers with charging service providers and support related digital services.

Depending on the service, EVvoltarc may provide software, charging discovery, verification, charging-session, payment, wallet, provider-management, badge, support, and related platform functionality.

EVvoltarc may operate as a technology platform or facilitator for certain services. The specific role of EVvoltarc may vary depending on the transaction and service involved.

3. Eligibility and Accounts

You are responsible for providing accurate and current information when creating or maintaining an EVvoltarc account.

You are responsible for maintaining the confidentiality of your account credentials and for activities carried out through your account, subject to applicable law and EVvoltarc's responsibility for matters within its control.

You must promptly notify EVvoltarc if you believe that your account has been accessed without authorization or that your account credentials have been compromised.

EVvoltarc may require identity, business, payment, or compliance information where reasonably necessary for a particular service.

4. EVvoltarc Services

EVvoltarc services may include, depending on availability and the applicable account type:

• EV charging station discovery
• Charging-session management
• Customer account services
• Service provider account services
• Charging-station information
• Provider verification
• Badge and assessment-related services
• Payment and wallet functionality
• Provider payout and withdrawal functionality
• Customer and provider support
• Public provider and verification information

EVvoltarc may add, modify, suspend, or discontinue individual features or services, subject to applicable law and any obligations that apply to an existing transaction or service.

5. Charging Services

EVvoltarc may provide software and platform functionality supporting EV charging transactions between customers and charging service providers.

Charging availability, charging speed, charging duration, energy delivered, pricing, parking charges, applicable taxes, station operating conditions, and other transaction details may vary by charging location and provider.

Customers should review the applicable charging price and transaction information before completing a charging transaction where such information is presented.

EVvoltarc does not guarantee that a particular charging station will always be available, operational, compatible with a particular vehicle, or capable of delivering a particular charging speed.

Customers remain responsible for using charging equipment in accordance with applicable instructions, vehicle manufacturer requirements, safety instructions, and station rules.

6. Service Providers

EV charging service providers may use EVvoltarc services to register charging locations, manage station information, receive charging-related transactions, participate in verification or badge programmes, and use other provider functionality.

A provider is responsible for the accuracy and completeness of information submitted to EVvoltarc, including station details, location information, operating information, business information, and applicable compliance documentation.

Provider information may be displayed publicly where the applicable service is intended to support charging discovery or provider verification.

7. Provider Responsibilities

Service providers are responsible for operating their charging locations in accordance with applicable laws, regulations, permissions, licences, safety requirements, insurance requirements, and applicable authority requirements.

Providers are responsible for maintaining their charging equipment, electrical infrastructure, site conditions, safety arrangements, required insurance, and other operational requirements applicable to their business.

Providers must not submit false, misleading, expired, or unauthorized documents or information to EVvoltarc.

Providers must promptly update EVvoltarc when material information about a charging location changes.

EVvoltarc may request additional information or suspend provider functionality where information appears incomplete, inaccurate, expired, or inconsistent with applicable requirements.

8. Verification and Badge Services

EVvoltarc may offer assessment, inspection, audit, compliance, verification, and badge services for service providers.

Current badge categories include:

• Bronze — Assessment
• Silver — Inspection
• Gold — Audit
• Platinum — Compliance

The applicable service fee is a fee for the professional assessment, inspection, audit, compliance evaluation, or related service performed by or on behalf of EVvoltarc. Payment does not guarantee that a provider will pass the applicable evaluation or receive an approved badge.

8.1 Rejection or Failed Evaluation

If an assessment, inspection, audit, or compliance check results in rejection, failure, or non-conformity, the applicable service fee remains payable and is not refundable solely because the provider did not pass the evaluation.

This is because the fee relates to the professional service, time, review, inspection, assessment, audit, or independent evaluation performed, and not to a guaranteed passing result or certificate.

8.2 Non-Conformity or Evaluation Report

Where applicable, EVvoltarc may provide a report or evaluation record describing identified non-conformities, rejected parameters, deficiencies, or other reasons for the result.

8.3 Corrective Action

Depending on the service type and evaluation result, the provider may be given a period or opportunity to implement corrective actions addressing identified issues.

8.4 Re-Assessment, Re-Inspection, or Re-Audit

Where a provider wishes to obtain approval after correcting identified issues, a follow-up assessment, inspection, audit, or compliance evaluation may be required.

Any required follow-up evaluation is a separate professional service and may require payment of a new applicable service fee.

8.5 Platform-Specific Validity

EVvoltarc assessments, inspections, audits, compliance checks, verification results, and badges are platform- specific services and status indicators.

Unless expressly stated otherwise, such assessments, inspections, audits, compliance results, and badges are valid only within the EVvoltarc platform and should not be represented as a government licence, statutory approval, statutory certification, or certification applicable outside the EVvoltarc platform.

A badge does not by itself guarantee that a provider, charging station, electrical installation, business, vehicle, or service is free from every risk, defect, deficiency, or future non-compliance.

8.6 Badge Validity and Status

Badge validity may be subject to the applicable validity period, programme requirements, documentation, verification results, payment, and continuing requirements.

EVvoltarc may suspend, revoke, expire, or decline to renew a badge where applicable programme requirements are not satisfied.

9. Payments and Wallet

9.1 Charging Payments

Customers may be required to pay applicable charging charges, parking charges, taxes, fees, or other amounts displayed or communicated for a transaction.

9.2 Payment Processing

EVvoltarc may use third-party payment service providers, including Razorpay, to process applicable transactions. Payment processing may be subject to the applicable payment provider's terms and policies.

9.3 EVvoltarc Wallet

Where wallet functionality is available, the EVvoltarc wallet is intended for supported platform transactions and services.

Amounts added to the EVvoltarc wallet are platform wallet funds and are not available for withdrawal as cash by the user or service provider.

The wallet may be used for supported EVvoltarc services, including applicable badge or other platform purchases.

The current maximum amount that a service provider may add through the applicable wallet payment functionality is ₹999 per applicable wallet addition.

EVvoltarc may change applicable wallet limits in the future. Any updated limit may be communicated through the applicable application, service, or updated Terms.

9.4 Wallet and Provider Earnings Are Different

EVvoltarc distinguishes between platform wallet funds and provider earnings. A wallet balance represents funds added for supported platform use and is not a provider earnings balance.

Provider earnings may arise from applicable charging transactions or other provider-related activities and may be subject to separate settlement and withdrawal rules.

9.5 Rewards, Promotional Credits, and Coupons

Where EVvoltarc provides rewards, promotional credits, coupons, referral benefits, or similar amounts, separate eligibility, validity, usage, or expiry conditions may apply.

10. Charging Cancellations and Refunds

EV charging transactions are commercial transactions between the Customer and the applicable Service Provider.

Accordingly, cancellation, refund, adjustment, or resolution of a charging transaction may depend on the applicable charging service, the Service Provider's applicable terms or policy, the transaction status, and applicable law.

EVvoltarc may provide the technology, transaction processing, payment facilitation, records, and support functionality required to facilitate the transaction. EVvoltarc may assist in resolving transaction issues but does not automatically become the commercial seller of the charging service merely because the transaction is processed through the EVvoltarc platform.

Where a refund or adjustment is approved or required, processing may depend on the applicable payment method, payment provider, banking or UPI systems, transaction status, and other applicable conditions.

Customers should contact EVvoltarc support when they need assistance with a charging transaction, particularly where the charging session, payment status, or refund status appears incorrect.

Nothing in these Terms is intended to exclude or restrict any consumer right, refund right, or legal remedy that cannot lawfully be excluded or restricted.

11. Third-Party Services

EVvoltarc may integrate with or provide access to third-party services, including payment providers, mapping services, communication services, hosting providers, authentication providers, and other technology providers.

Third-party services may operate under their own terms, privacy policies, availability conditions, and service limitations.

EVvoltarc is not responsible for independent third-party services to the extent that their operation is outside EVvoltarc's reasonable control, subject to applicable law.

12. Acceptable Use

You must use EVvoltarc services only for lawful purposes and in accordance with these Terms.

You must not:

• Use EVvoltarc services for unlawful or fraudulent activity.
• Provide false, misleading, fraudulent, or unauthorized information.
• Attempt to access another person's account without authorization.
• Circumvent security controls or authentication systems.
• Interfere with the operation or availability of the platform.
• Introduce malicious code, malware, or harmful software.
• Scrape, copy, or systematically extract platform data without authorization.
• Misuse provider verification, badge, or public verification information.
• Impersonate EVvoltarc, another user, provider, or organization.
• Use EVvoltarc services to infringe another person's rights.

13. Content and Intellectual Property

Unless otherwise stated, the EVvoltarc website, applications, branding, logos, software, designs, text, graphics, interfaces, and other platform materials are owned by or licensed to EVvoltarc and are protected by applicable intellectual-property laws.

You may use EVvoltarc content only for the purposes permitted through the applicable service.

You must not reproduce, modify, distribute, sell, reverse engineer, publicly display, or commercially exploit EVvoltarc materials except where permitted by applicable law or with EVvoltarc's written authorization.

User and Provider Content

Users and providers remain responsible for content and information they submit to EVvoltarc.

By submitting information or content, you represent that you have the necessary rights and authority to submit it and that its submission does not unlawfully infringe the rights of another person.

14. Service Availability

EVvoltarc aims to provide reliable services but does not guarantee uninterrupted or error-free availability.

Services may be unavailable or limited because of maintenance, software updates, infrastructure issues, network failures, payment-system issues, security incidents, third-party outages, power failures, or other circumstances.

EV charging availability may also depend on factors outside EVvoltarc's control, including electricity supply, station equipment, site access, provider operations, vehicle compatibility, and local network conditions.

15. Liability and Disclaimers

EVvoltarc provides platform and technology services. Certain services involve independent service providers, payment providers, infrastructure providers, and other third parties.

Charging Station Responsibility

Service providers are responsible for their charging stations, equipment, electrical systems, site conditions, safety arrangements, applicable licences, insurance, and compliance obligations.

EVvoltarc does not own or control every charging station listed on the platform and does not guarantee that every provider or station will remain operational or available at all times.

Vehicle and Charging Risk

Customers are responsible for following vehicle manufacturer instructions and charging-station safety instructions.

To the extent permitted by applicable law, EVvoltarc is not responsible for damage caused by improper use of a vehicle, charging equipment, electrical installation, or third-party property, or by circumstances outside EVvoltarc's reasonable control.

Information and Availability

EVvoltarc aims to maintain accurate platform information, but charging availability, pricing, station status, location information, and other details may change and may not always update immediately.

Limitation of Liability

To the maximum extent permitted by applicable law, EVvoltarc will not be liable for indirect, incidental, special, consequential, or punitive losses arising from use of the platform where such exclusion is legally permitted.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law.

16. Indemnification

To the extent permitted by applicable law, you may be responsible for losses, claims, liabilities, damages, and reasonable costs arising from your unlawful use of EVvoltarc services, violation of these Terms, infringement of another person's rights, or information or content submitted by you.

This provision does not apply to the extent that the relevant loss or claim results from EVvoltarc's own conduct where applicable law does not permit such liability to be transferred.

17. Suspension and Termination

EVvoltarc may suspend, restrict, or terminate access to an account or service where reasonably necessary because of suspected fraud, misuse, security concerns, violation of these Terms, inaccurate information, non-payment, regulatory requirements, or other legitimate operational reasons.

Where appropriate and legally required, EVvoltarc may provide notice or an opportunity to resolve the relevant issue before restricting access.

Termination does not automatically cancel obligations that arose before termination, including applicable payment, transaction, dispute, or legal obligations.

18. Privacy

EVvoltarc's collection and processing of personal information is described in the EVvoltarc Privacy Policy.

By using EVvoltarc services, you acknowledge that applicable information may be processed in accordance with the Privacy Policy and applicable law.

19. Changes to These Terms

EVvoltarc may update these Terms from time to time to reflect changes to its services, technology, business practices, legal requirements, or operational processes.

The current version will be published on this page with its applicable version number and last-updated date.

Where applicable law requires additional notice or consent for a material change, EVvoltarc will provide the appropriate notice.

20. Governing Law and Disputes

These Terms are intended to be governed by the laws applicable in India, subject to any mandatory rights or protections available to users under applicable law.

EVvoltarc encourages users and providers to contact support first so that transaction, account, service, or other disputes can be reviewed and resolved where reasonably possible.

Nothing in these Terms is intended to prevent a consumer or other person from exercising a legal right to approach a forum, authority, regulator, or consumer commission that has jurisdiction under applicable law.
